2. Who are these terms and conditions intended for?

These terms and conditions apply to companies and organizations that use our services. (Hereinafter: “customer”)

3. Our Services

We offer digital " Teamenergy " assessments to support team development.

In addition, we offer training courses for team coaches, team leaders, and team members to further develop their expertise in the philosophy of Teamenergy. These courses are available both in person and online.

The process at Teamenergy Metingen works as follows. Teams complete a questionnaire, after which they receive a digital report containing insights and specific recommendations. Teams can then use this information to take action on their own. The entire process takes place online.

For any Interventions related to the report—such as coaching programs, training sessions, and team sessions—we refer you to one of our accredited team coaches. These team coaches have been trained by us in the philosophy of Teamenergy and can guide you through Interventions when external guidance is desired. 4. Rates and Subscriptions

Customers can choose from several options for purchasing the Teamenergy Measurement. The measurement can be purchased individually, through a custom agreement, or via a subscription. The currently applicable rates are listed on the website at Teamenergy.

A subscription is automatically renewed for one year unless it is canceled in writing at least 2 months before the renewal date.

Either party may terminate the agreement in writing before its expiration if the other party fails to fulfill its obligations and does not remedy such failure within a reasonable period of time.

Prices do not include VAT, unless otherwise stated.

5. Billing and Payment

Payment is generally made online immediately upon receipt of the service.

In the case of a custom contract, arrangements regarding billing can also be made Tailor-made .

The payment term for a custom-made contract is 30 days from the invoice date. After that period, we will send a reminder. A second reminder will follow two weeks later. If payment has still not been made by then, we may refer the claim to a collection agency and terminate the contract immediately.

Any collection fees will be borne by the customer.

6. Liability

Our reports are based on responses from team members and on our own scientifically grounded model. We do our best to provide reliable insights, but this remains a tool for guidance. Teamenergy is not liable for any decisions or consequences resulting from the use of our reports.

7. Intellectual Property & Data

The client owns the reports we deliver. Teamenergy retains ownership of the model and methodology behind the measurements.

We use only anonymized data to improve our model. Reports cannot be traced back to individual people.

We do not retain data any longer than necessary. Any data that we are not permitted to retain under the GDPR is carefully and promptly deleted.

Teamenergy uses artificial intelligence. With the AI Act, the European Union has established regulations for companies that use artificial intelligence. Teamenergy is fully compliant with these regulations and undergoes an annual audit to verify compliance.

8. Force Majeure

If, due to circumstances beyond our control (such as system failures, government measures, pandemics, or cyberattacks), we are temporarily unable to provide our services, our obligations will be deemed suspended for as long as the situation persists. We will notify customers of this as soon as possible.

9. Customer Responsibility

The customer is responsible for providing data in a timely and accurate manner and for sharing the reports within the organization. Teamenergy is not responsible for errors resulting from incorrect or incomplete input.

11. Governing Law

These terms and conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.

12. Changes to the Terms and Conditions

We reserve the right to modify these terms and conditions. If any changes are made, we will notify you at least 30 days in advance. If you do not agree with the change, you may cancel your subscription before the change takes effect.

13. Final Provision

If any provision of these terms and conditions is found to be invalid, the remaining provisions will remain in full force and effect.
